Buryat social networks are discussing the decision of a married 35-year-old woman to install a hidden camera in the apartment she rents to a student. This became known when the owner shared with her friend intimate details from the life of the tenant. While the story is being spread in anonymous public pages and the media, the woman may face criminal liability for what she did, Dmitry Itskov, head of the corporate practice of the Malov and Partners bar association, told iz.ru.

The private life of any citizen is protected by Article 23 of the Constitution. Considering that the landlord, when renting out an apartment, provides it for personal residence, he has no further right to violate its integrity. And video monitoring is a violation of privacy.

It is difficult to say what compensation might be [for secret surveillance of residents], because such cases are quite rare. But if the tenants discover the camera, call law enforcement officers, who will record the cameras and find out that the signal is transmitted to the landlord’s device, there will be no difficulty in proving guilt. Compliance with the Constitution is ensured by Art. 137 of the Criminal Code, which is called “Violation of privacy”. And the likelihood of criminal prosecution is quite high if there is a certain persistence on the part of the tenants.

Representatives of most companies whose websites list services for installing hidden cameras declined to comment. Only one stated that this information “is not a public offer”, but is indicated “just so that more people come to the site.” And he said that the flow of people wanting to install hidden cameras in apartments does not dry up, and in the spring it even increases.

“They ask often, we have a large country, in the spring such cases become especially frequent when people feel like they are being gassed or their Wi-Fi is being irradiated,” the source told iz.ru. He noted that there are also those who want to monitor whether residents are stealing furniture in a rented apartment. But he emphasized that the company only installs open cameras. And it doesn’t work with such clients, since it’s impossible to convince them to install open cameras.

Roman, a representative of the Video5.rf company, also immediately stated that he does not engage in hidden video surveillance. But he said that a small part of the clients who come for hidden cameras (“and these are the majority”) can be convinced. Roman, representative of the Video5.rf company.

The company representative added that among those who can be convinced (“this is about 20 percent”), there are those who rent or are preparing to rent apartments. As a result, they place the cameras completely openly. “This happens quite often. And there is no problem with that. Everything [with the tenants] happens amicably,” the publication’s interlocutor added.

A private detective who anonymously commented on the case in Buryatia to the newspaper “Number One” also recommends installing open cameras in rented apartments. “We immediately tell our clients that in any unclear situation they need to install a camera. What's wrong if you know what's going on in your apartment? The only thing that must be fulfilled is the written consent of everyone who permanently resides in the apartment. So, you can install video surveillance in the apartment you rent. But then this condition must be written down in the contract.”

According to the expert, cameras are justified in two cases. Firstly, if in one of the rooms there are valuable things of the owner of the apartment. Secondly, if there are concerns that tenants may initiate a robbery.

But the detective, and former employee of the Ministry of Internal Affairs, could not remember such cases.

Lawyer Dmitry Itskov warns that even “amicable” video surveillance prescribed in the lease agreement can end in a criminal case for the owner. “Contractual relations can provide for certain restrictions in relation to the parties to the contract. This includes consent to install surveillance cameras. That is, the tenant will no longer be able to carry out direct dismantling. But the right to protection of private life is still guaranteed by the Constitution. But according to Russian law, waiver of rights is not allowed. That is, the tenant can withdraw his consent at any time. From this moment on, video filming will be prohibited, and re-signing of the contract will not be required,” the lawyer said. “Moreover, if guests come to an apartment where cameras are openly installed, they will be able to sue the landlord. Being a guest is an element of privacy and they have the right to demand respect for their rights.”

Not a single realtor interviewed by iz.ru recalled a case when apartment owners officially notified tenants about CCTV cameras. Only one told about the only case in her five-year practice, when the apartment owner tried to secretly monitor the residents. “People rented an apartment and later found out that the owner had installed hidden cameras. Naturally, there was a scandal; no one would want to live in such conditions. But they separated and went their separate ways, there was no trial,” said the realtor.

“I was completely shocked, speechless. I don’t want this to happen to anyone else,” says a 51-year-old American woman who was tried to be raped by the owner of an apartment rented through the popular Airbnb service. The woman filed a lawsuit against the company - in her opinion, the employees of the rental platform were negligent by not checking the identity of the landlord.

Leslie Lapwalker, 51, arrived in Los Angeles in July 2016 to work as a mortgage broker, writes. She planned to buy a home, and during the search period she rented a studio attached to a private house. The owner of the cottage, Carlos Del Olmo, had the status of a “superhost” on Airbnb, but, according to Lapwalker, he made vulgar comments about her from day one. In addition, he loudly shouted at his own son, and after three nights in his house the woman decided to move out. She packed her things and informed Del Olmo of her decision. He lured her back to the studio, locked the door and began to harass her, and said goodbye: “Don’t forget to leave me a good review on Airbnb.”

After much doubt, Lapwalker reported the incident to the police and Airbnb. The authorities refused to bring a case against the “superhost” - there was no evidence at all, but the woman’s lawyer found out that Del Olmo had previously been prosecuted for domestic violence. Now Lapwalker wants to sue Airbnb for its negligence in screening the man.

A year earlier, in the state of Nevada (USA), a grand jury found the validity of the charges brought against the owner of the house, who was watching the tenants using hidden cameras. The man, who also rented out housing through the Airbnb portal, installed six such devices in different rooms of the mansion, including in the bathrooms.

One of the guests accidentally noticed the lens built into the smoke detector in the toilet and reported his discovery to the police. Officers searched the home and found five additional video devices installed in the master bathroom and guest bathrooms.

An investigation was carried out. According to police, it is possible that the landlord made several recordings of the tenants without clothes. The man was charged with eight counts of unlawfully obtaining images of another person's private parts.

Even earlier, at the end of 2015, German Edith Schumacher was sued on Airbnb for having a hidden camera in an apartment she rented in Irvine (California, USA) in 2013. The woman stayed in the house with her partner, they walked around the house naked and discovered the video recording device turned on under the candles only on the third day of their stay in the apartment.

Hidden cameras have been found in apartments and houses for rent not only in the United States, but also, for example, in Japan and Taiwan. In January 2017, actor Jean-Paul Manu, known from the TV series “ER,” was convicted of installing a hidden camera in a rented apartment in Toronto (Canada).

The woman sued the owner of the company, Michael Lucas - by the way, his real name is Andrey Treivas, he was born in Moscow.

About a year ago, in Sweden, housing advertised on the Airbnb website began to be actively used by prostitutes and pimps: they rent hundreds of apartments in Stockholm through the service. City police investigator Simon Heggström said that to achieve this, pimps and their charges create fake accounts on Airbnb. Guests, in turn, are prohibited from spying on other people or otherwise invading their privacy: “The use of any surveillance devices by a guest over the host or third parties in the accommodation is permitted only with the consent of these persons,” Airbnb clarifies .

Surveillance devices include Wi-Fi cameras, video and baby monitors, web cameras in monitors, stationary or portable video surveillance systems, as well as smartphones with video and/or audio recording capabilities. For violating the rules, the company threatens to block or completely delete the user’s account.

For tenants at risk of becoming the stars of explicit videos, this is little consolation. Experts advise checking your home before moving in: most often, cameras are hidden in smoke detectors, books, house plants and soft toys.
